1. Purpose and acceptance

These Terms and Conditions govern access to and use of the RastraTec platform. Access to the platform implies full and unconditional acceptance of these terms.

2. Service description

RastraTec offers a SaaS transport management platform that includes:

  • Real-time GPS monitoring of vehicles.
  • Fleet data telemetry and analytics.
  • Schedule, route and personnel management.
  • Automatic alerts and notification system.
  • Operational and statistical reports.

3. Access and registration

Access to the platform requires prior registration. The user is responsible for maintaining the confidentiality of their credentials and for all activities carried out under their account. Any unauthorised use must be reported immediately to [email protected].

4. User obligations

The user agrees to:

  • Use the platform exclusively for lawful purposes and in accordance with its intended use.
  • Not attempt to access data belonging to other users or clients.
  • Not reproduce, distribute or modify the software or platform content.
  • Keep contact and billing details up to date.

5. Service availability

RastraTec strives for maximum platform availability but does not guarantee uninterrupted service. It assumes no liability for interruptions caused by:

  • Internet connectivity failures or mobile operator outages.
  • Power outages.
  • Insufficient or absent GPS signal.
  • Scheduled maintenance, communicated in advance.
  • Force majeure events.

6. Intellectual property

All software, interfaces, algorithms, reports, designs, logos and platform content are the exclusive property of RastraTec or its licensors. Any unauthorised use is prohibited, including reverse engineering or copying the system.

7. Vehicle and operator data

Geolocation and operational data generated by vehicles is the property of the contracting transport organisation. RastraTec processes it solely for service delivery and may use it in anonymised, aggregated form for system improvement.

8. Limitation of liability

RastraTec shall not be liable for indirect damages, loss of profit or data loss arising from the use or inability to use the platform, except in cases of proven fraud or gross negligence.

9. Modifications

RastraTec may modify these terms at any time. Registered users will be notified at least 15 days in advance of substantial changes. Continued use of the platform after notification implies acceptance of the new terms.

10. Applicable law

For any dispute, the parties submit to the courts of the United States; for clients in Bolivia, to the courts of Cochabamba, Bolivia.
